Bella Vista Council To Vote On Hunting, Franchise Fees
BELLA VISTA -- Bella Vista City Council members will vote today on ordinances to ban hunting within the city and to establish franchise fees on three utilities.Bella Vista Mayor Frank Anderson said the city's need for hunting and firearms regulations comes from hunting season being just around the corner. The council will vote on two ordinances -- one to regulate the use of firearms and the other to ban all hunting within the city's boundaries.The Bella Vista Property Owners Association, which has boundaries similar to the city's limits, already prohibits the use of firearms, Anderson said. The only difference is that people will no longer be allowed to bow hunt in Bella Vista.Anderson said some residents were upset last year because people were hunting from tree stands in empty lots next to their homes.Alderman Doug Farner said he supports the ordinance to ban hunting."That is not a safe thing," Farner said.
Judge Strikes Down State Law Permitting Cable Franchise Fees
DES MOINES (AP) - A Polk County judge has struck down a portion of a state law permitting city governments to assess fees of up to five percent on cable television connections.Judge Michael D. Huppert says in his ruling that the Legislature violated the state and federal constitutional rights of a woman who sued the city of Des Moines claiming its cable franchise fees are illegal.In his ruling, Huppert says a law passed earlier this year that permits city governments to assess the fee and makes the law retroactive violates a person's constitutional right of due process. He says only two types of retroactive laws in Iowa can pass constitutional muster, emergency legislation and laws passed to cure errors in earlier laws. He say the retroactive cable franchise law is neither.Huppert says cable subscribers cannot seek damages for franchise fees paid after May 29th when the law became effective.
